Official Contest Rules

 

 

No purchase necessary to enter or win. No cost to enter. Making a purchase will not increase your chance of winning. Void where prohibited.

 

1)    The PIVOT “PICK-IT” MARCH MANIA (the "Contest") from Pivot Group, LLC and Alpine Communications (“Sponsor”) is a contest intended for online participation by persons in the 50 U.S. states. The Contest is sponsored by Alpine Communications. located at 923 Humphrey Street Elkader, Iowa 52043 and Pivot Group, LLC located at 7145 SW Varns St., Suite 101, Portland, OR 97223 and utilizes a website and related electronic tools (“the Site” or “Contest Site”) developed and/or managed by Pivot Group, LLC (“Pivot Group,” “Site,” or “Administrator”). This Contest is subject to the laws of the State of Oregon and the United States. In this document, Pivot Group and Alpine Communications are collectively referred to as “Sponsors,” "we," "us" or "our".

 

 

2)    To Enter: Click on the link provided by Sponsors. Make your selections on the Contest Site according to the provided instructions at any time until start time of first game on March 18, 2010. You (“Participant”) will be asked to provide your name, email address, your company name, and possibly other information to create and validate an entry (“Submission”). By submitting, and validating your entry via responding to a confirmation email, you are automatically entered into the Contest. By submitting you are acknowledging your acceptance of, and agreement to be bound by, these Contest Rules and any corresponding Privacy Policy. Submissions cannot be changed after Submission in the Contest unless specifically noted on the Contest Site. The Contest is open between 12:01:00am CST March 6, 2010 and start time of the first game on March 18, 2010. Entries become the property of the Sponsor and will not be returned. In the event of a dispute regarding the identity of the person submitting an electronic entry, the entry will be deemed to be submitted by the person in whose name the e-mail account is registered. Only one entry per person is allowed.

 

3)    Eligibility: Any legal U.S. resident, at least 18 years of age at time of entry with a valid email address can register and submit an entry into the Contest. Valid eligible entries must meet the following criteria:

a)    A resident of a serving area of Alpine Communications

b)    Be 18 or older at the time the competition starts.

c)    Be a current U.S. resident.

d)    Have a valid email address that is unique for the Participant.

e)    If you are unsure if you meet the above criteria, please contact a Sponsor.

 

Employees of Pivot, its parent company, and their respective affiliates, agencies, Pivot Group LLC., and members of their immediate families are not eligible to win. Void where prohibited by law or regulation. All federal, state and local laws and regulations apply.

 

4)    Scoring: The Contest website provides details on the scoring system that applies to this Contest. Contests participants may receive periodic updates via e-mail that provide participant score, rank and information on the scores and ranks of other participants. Entrants agree to the release of their name, address, and e-mail information to Pivot Group for score updating, posting and winner notification purposes, only; otherwise, please review Sponsors’ privacy policy for more information on how we use any personal data we collect from you.

 

5)    Tie-breakers: The Contest website provides details on the tie-breakers that apply to this Contest.

Tie-breakers will be determined by Pivot Group, LLC (The “Independent Judge”).

 

6)    Winner Notification: Winners will be notified within one week of the final Contest event by Sponsors. Potential prize winners will be notified by e-mail to the address provided during entry, with follow-up documentation, including an affidavit of eligibility and liability/publicity release, sent by regular mail or e-mail. Potential winner response to their e-mail notifications must be received within 10 days of receipt, or be disqualified and the follow-up documentation must be returned in 7 days after winner response. If no response is received or if the completed documentation is not received within the above time periods, an alternate winner may be selected. If prize notification is not responded to or any prize is released as undeliverable, prize will be forfeited and awarded to an alternate. Entering an incorrect or incomplete e-mail address in the registration process, or failing to meet the eligibility requirements above, will result in contest disqualification. By accepting any prize, winner grants Sponsor the right to use his/her entry, name, likeness and biographical information in any and all media for advertising/Contestal purposes.

 

7)    Prizes:

 

a)    Prizes are detailed on the Contest web page.

b)    Taxes on prizes are the sole responsibility of the winner.

c)    Prizes are non-transferable and must be accepted as awarded.

d)    Some prize restrictions may apply.

e)    The odds of winning depend on the number of entries received by the contest deadline and the skill of the contest participant.

 

8)    Limitation of Liability: Sponsor and Independent Judge are not responsible for late, lost, misdirected, or incomplete entries; or entries that are lost due to computer, Internet, or electronic malfunction. Sponsor reserves the right to cancel or modify contest and award the prize through an alternate means if fraud or technical failure compromises the integrity of the contest, as determined by sponsor in its sole discretion. Entrants agree that the sponsor, its Contest partners, related companies, agencies, and their respective employees or officers shall not be liable for injury, losses, damages, or costs of any kind resulting from participation in this contest or acceptance of or use or misuse of a prize or parts thereof. By entering, participants agree to be bound by these Official Rules.

 

9)    Winner List: For the name of the winners, send a self-addressed, stamped envelope no later than one week after Contest completion to: Pivot Group LLC, 7145 SW Varns Street #101, Portland, Oregon 97223.

 

10)     Other Contest rules and notes:

 

a)    By submitting, entrants consent to the use of their names, contest scores and rankings, and city of residence in connection with this contest. Sponsor has the right to communicate winners’ name, city name, scores and other Contest related information publicly during and after the contest. If needed winners consent to use of their photograph and/or image on videotape for publicity purposes in all media carried out by Sponsor, without payment or compensation.

b)    By submitting, participants consent to Sponsor’s use of personal information including email address to communicate to participants in the future about Sponsors’ services, special offers, or other communication.

c)    We reserve the right, in our sole discretion, at any time to disqualify any Submission that does not comply with the requirements set forth in these Contest Rules, or if the Submitter is not in full compliance with these Contest Rules. We have the right, but not the obligation, to review and monitor the submissions. If we determine (through our own review or third-party notice) that a submission does not comply with the requirements set forth in these Contest Rules or is otherwise inaccurate, the submission may never be posted or may be removed from the Contest website without notice to the Submitter.

d)    The Contest rules are subject to change, at Sponsors' sole discretion, and any changes will be posted on Pivot Group’s website or in modified rules posted on the Contest website.

e)    The sponsors bear no liability arising or pursuant to, or as a result of the carrying out of the contest, including liability and from the acceptance of and participation in the prize as awarded and confirming compliance with contest rules.

f)      Participants agree that the decisions of Sponsors with respect to any and all aspects of Contest shall be final, including eligibility, judging and prize fulfillment.

 

11)         By entering this contest you acknowledge having read and accepted these rules.

 

12)         NCAA®, Final Four® and March Madness® are registered trademarks of the National Collegiate Athletic Association.  This website, the “Pick It" March Mania Challenge contest, Alpine Communications and Pivot Group, LLC are not affiliated with or otherwise authorized, sponsored, endorsed, licensed or approved by the National Collegiate Athletic Association. The National Collegiate Athletic Association is not a participating partner in or sponsor of this contest.

15)          NO ENDORSEMENT:   Nothing contained in these Official Rules or in any of the contest materials should be construed as an endorsement by Sponsors of any prize, manufacturers or suppliers, or other third party, product, or service.  All trademarks are the property of their respective owners and no sponsorship, endorsement or affiliation with Sponsors, their respective products, or this contest is implied by their use.
